Can Chief Justice Renato Corona Emerge from His Impeachment Trial Unscathed?

n Monday, January 16, the first ever trial to oust a Chief Justice begins. Senators take their oath as judges for the impeachment trial against Supreme Court Chief Justice Renato C. CoronaAll 24 Senators, clad in newly tailored red robes will sit as judges to determine corona’s guilt or innocence on each one of the eight impeachment complaints that encompass a betrayal of public trust, culpable violation of the Constitution, graft and corruption, and his overt partiality towards Former President Gloria Macapagal Arroyo.

Despite Corona’s defiant stand against his accusers, his loyal supporters surrounding him, even his tearful candlelight novenas, public support for the embattled Chief Justice has been waning. An SWS survey released on Friday, January 6th showed that Corona’s ratings plummeted to -14 with 35 percent of respondents stating they were no longer satisfied with his performance.

Just a few days ago, House prosecutors stated that they have evidence to show that Corona amassed 40 properties during the 9 years Arroyo was president. In an TV interview, Corona stated that his accusers listed some properties more than once. However, he did not say how many properties he actually had. Even if one presupposes that all his properties were erroneously listed twice, we are still left with hefty quantity of 20 properties—some located inside Fort Bonifacio worth tens of millions of pesos.Renato Corona, the first Chief Justice impeached by the House of Representatives One property in particular, a penthouse condominium unit with three parking slots cost the Coronas Php14.5 million, though real estate experts say it is worth significantly more than that. Did the developer Megaworld give Corona a hefty discount? If so was it because he was the Chief Justice?

However one cuts it, Corona is “damaged goods” no matter what the outcome of the Senate trial. All the allegations of impropriety that have come out these past weeks have already given many Filipinos the proof they needed to confirm what they suspected all along: that the high court is riddled with corruption. In fact the public would likely be demanding more Justices impeached as the country performs a long-overdue “spring cleaning” of the court.

So, even though our eager Senators, in their fancy red robes will go through the motions of playing judge and grandstanding before the TV cameras, the far-reaching effects of this impeachment trial have already been determined well before the opening gavel on Monday. Published 1/14/2012

Unscathed, did you say? The man is the poster boy for corruption. He has nothing more to recover. And what is alarming is he is dragging the entire Judiciary down along with him. PNL: I love your take on Corona's impeachment. The people have to be convinced that these senators hearing the case are with the people or against the people. Like any case under litigation, the defendant always ends up being humiliated and embarrassed. It is no different from a rape case. Now prosecutors "let the cat out of the bag.". Too many properties amassed in a very short number of years of association with Gloria as a consigliore. Corona obviously became the first responder to Gloria's frantic 911 call. His response became a bane to his job! Whatever the outcome is, he is wounded, bloodied and seriously damaged. A "damaged good" indeed.

Justice Corona never had the respect of the Filipino people since his midnight appointment. The decision of his co-Arroyo appointees in the Supreme Court to uphold his appointment by virtually amending the constitution even worsened that perception. Thus, it was up to Corona to prove to the people that he was well worth the appointment. Instead, his decisions in the guise of being "collegial" in favor of the past administration placed his reputation in a steep downward slide culminating in this impeachment trial. His best recourse now is to resign to save whatever is left of his reputation, if there is still any.

The trial will allow the major issues to be properly addressed in a sober & orderly proceedings. The back & forth allegations, accusations, innuendos, insinuations & fakeries to win public opinion on both camps must end now. The lawyers must present their cases before the senators. The novena masses by the Corona camp might help. Still, it will be a very tall order for him. CJ Corona said..' Mr. President, I am Primus Inter Pares (first among equals)', well, we'll soon see. I don't care that some said that the impeachment was unconstitutional. Wait a minute, my question is, who first violated the Constitution? Of course Corona, why? because he accepted the CJ position from a fake pres. Corona and his spokesperson seem to convince the people to believe that the integrity of the whole judicial branch of the government, the supreme court, is the one that is being questioned so their supporters are being blinded to gain sympathy on their side. There are 2 articles in the Impeachment of CJ Corona which I believe will pin him down : Partiality and subservience in cases involving Arroyo and the issuance of TRO granting GMA to go to Singapore to evade arrest. How can he justify such an act? It is crystal clear he just closed his eyes and endowed GMA with his generous assistance. If he is a man of integrity being GMA’s beneficiary this is his golden chance to focus impartiality and to show the people that the highest court of land cannot be easily swayed by a mere owe of gratitude. The laws that Justice Corona violated are criminal statutes: tax evasion, plunder (or ill-gotten wealth & so forth. We have read so much damaging report about how GMA and Corona conspired resulting to so much abuse and mismanagement of the Republic. First, judging from what we read about the charges and possibly evidences, Corona has no chance to escape this unless some Senators who hate Pres Aquino would betray their country in exchange for their emotion. I do believe that if Justice Corona can't justify the legality or legitimacy of his questionable acquisition of properties, the Philippine Republic has a jurisdiction to confiscate his ill-gotten wealth for the common good. It seems that Justice Corona is engaged in shady dealing with different banks, which is akin to being a member of "the mafia king of banks in Italy." I do believe that the impeachment, conviction & removal of Justice Corona from the bench will make Philippine democracy one of the most transparent, genuine & strong democratic institutions in the world. But the Senate's vote to acquit Justice Corona despite the hard evidences that he violated established judicial norms is tantamount to approving a brand of Justice Corona's judicial independence or judicial philosophy: criminal activity, treason & betrayal of public trust (tax evasion, plunder, conspiracy to commit fraud, acquisition of ill-gotten wealth, etc) are not grounds or litmus tests for judicial impeachment & conviction.

The public officials' rank and file from top to bottom should submit SALN to clearly show if they are accumulating ill gotten wealth. This rule should be strictly adhered to and monitored. A House Committee could be designated to oversee the submission of SALN, dissecting them, and filing of cases for those who acquired ill gotten wealth. Comments on the SJ trial is waste of energy. Watching the prosecuting team in action on day one showed the world how, inept and incompetent what should be the Philippines' "A-team." I do agree with other critics that Corona's impeachment, conviction & possible jail time will create a stronger Philippine democracy. It will restore public trust, or public confidence in the Court & continuity in constitutional & doctrinal development. In a democracy, the Courts can't escape critical denunciation: the interaction between the Constitution itself ("We The Filipino People") & an independent textual authority. "This processes ensure the continuation of critical scrutiny." It is only right & just to remove Corona from the bench because of his lacked of integrity, or judicial candor, & his ongoing role as a symbol of political & judicial corruptions. There's a total of 8 specific impeachment complaints against DJ Corona. This historical trial will be tried on two levels: in the court of law & in the court of public opinion. The final judgment must be based on verified facts & applicable laws. RE: CJ Corona and the World Bank? (WB...It appears that the WB released $21million (US dollars) the purpose of which was to fund judiciary reform.. The WB wrote a letter questioning the expenditures as not resulting in any progress on the purposes for which the money was provided.. The Judiciary Reform Support Project (JRSP)...Midas Marquez, Court administrator was authorized the release or sign payment up P200,000 later increased to P500,000.. guess what the SC also advance the money used for travel funds for Justices.. My message to our Senators-judges is to see and scrutinize not only the evidence from both the prosecutors and defense but also give credence to the public opinions which are integral part and very essential in this kind of proceeding. I would not be surprised if after a verdict is reached by the senate, Renato Corona will come out with a crown of thorns. He will be crucified and vilified. I am surprised with this Integrated Bar of the Philippines (IBP) how "vigilant" they became in protecting Corona. They were too quite when the appointment was made by Arroyo for Corona as Chief Justice of the Philippine Supreme Court. Any 1st year law student (or any student for that matter) who have studied the Philippine Constitution knew it was made illegally by Arroyo. The IBP should know much better. Why? For the best interest of justice in the Philippines, Corona should resign. The evidence which he claimed are "hoaxes", particularly in the graft and corruption case are overwhelming and embarrassing. It appears that the media blitz is about covering up the present administration's hidden skeletons and inflate the wrongdoings of Corona. Here are several reasons, read Neal Cruz's article. Certainly annoying to see why the law is not balanced. I guess who ever is in power can dictate the outcome of the law and it's verdict.

Blitz Marlon Berg said CJ Corona violated the Constitution because he accepted the post of Chief Justice from “a fake pres, GMA 2 months before she was to leave Malacañang and also GMA's appointment of Corona's wife to a managerial position in the gov't. Blitz, his appointment was made squarely pursuant to the Constitution. Moreover, his appointment has been confirmed valid by the SC during the Watch of CJ Puno. BTW, Corona’s wife was appointed to a managerial position before his appointment to the SC. Now, please explain why his appointment as Chief Justice and why the appointment of his wife PURPORTEDLY violated the Constitution.

Vanessa Lee said “There are 2 articles in the Impeachment of CJ Corona which I believe will pin him down: Partiality and subservience in cases involving Arroyo and the issuance of TRO granting GMA to go to Singapore to evade arrest…” Ms. Lee, foremost, the Hold Departure Order called Watch List Order (WLO) issued by the DOJ to prevent GMA’s travel abroad was null and void because there was no criminal case against GMA to warrant its issuance. A null and void WLO cannot prevent the issuance of the said TRO. Rather, it justified issuance of the TRO. Moreover, the SC is a collegial body and rules on majority votes. CJ Corona has only 1 vote. If these are the strongest arguments for Corona’s impeachment, expect that he’ll be acquitted by the Senate Trial Court.

During the opening statement in the Impeachment Trial of former SC Justice Serafin Cuevas, counsel for CJ Corona, he contended that there was no notice and hearing made by the House of Representatives in favor of CJ Corona, hence, he was impeached in violation of his basic Constitutional right that no person shall be deprived of his life, liberty or property without the due process of law. Thus, the Articles of Impeachment is null and void, hence, ineffective. No objection has been interposed by the Prosecution. So, this is admitted as part of the records of the case. What will the Senate Trial Court do with this illegality comes judgment time? Trash the whole case, of course.
